| Rapid development of intelligent internet has produced so many revolutionary results and formed contemporary characteristics, such as dual layer space- virtual reality isomorphism, man machine coexistence- intelligent interaction and algorithm leading- digital ecology. These make it difficult for existing legal norms to effectively cover and adjust, make the explanatory power of existing rule logic seem increasingly difficult, and make the existing mechanism of judicial settlement encounter obvious obstacles. Therefore, it will inevitably lead to profound legal reform. Firstly, in terms of legal value, there will be some new viewpoints, such as data justice, code justice and algorithm justice. Secondly, in legal relationship, the relationship between right and obligation is facing a fundamental remodeling and the relationship between power and right has undergone structural transformation. Thirdly, on legal act, the complex behavior pattern, cause-effect relationship and social consequence have been formed, based on the dual space, man-machine mixture and behavior coordination. Thus, we need establish contemporary legal idea which adapts to development requirements of intelligent internet era, construct legal system of whole fusion, explore new-style code regulation method, mold highly autonomous refinement governance order, promote intelligent development of law enforcement and judicature, and implant risk-controlling systematic mechanism, so as to promote transformation and upgrading of legal system and rule order. |
