In China, procuratorial organs, unlike other law enforcement and supervision agencies, have no power to directly deal with objects of law enforcement and supervision. Therefore, in order to carry out legal supervision, they need the support of the investigation power of crimes of the dereliction of duty. After the reform of the national supervision system, the procuratorial system faces severe challenges because procuratorial supervision has lost the support by investigation power, which will lead to further softening of litigation supervision and weakening of the procuratorial system with Chinese characteristics. In the context of comprehensively advancing the rule of law in China, it is necessary for the procuratorial system to maintain strategic focus and adhere to the constitutional orientation. China should retain the power of procuratorial organs to investigate crimes of the dereliction of duty found in the performance of duties, give procuratorial supervision hard binding force, and enhance its rigidity by giving procuratorial organs the power to carry out investigation and verification and to take other necessary measures for supervision, and gradually expand the procuratorial function by such measures as establishing the system of application for constitutional review and expanding judicial review and administrative inspection, so as to consolidate and develop the socialist procuratorial system with Chinese characteristics in a new era. |
