The rights system on the rural house sites under the current law is not working. In practice, there are a large number of "extra-legal" use of the rural house sites in such cases as rural house sites inheritance, internal transfer, cross-village allocation, resettlement, market utilization, and operational use, which diverse in terms of their subject, function, and usage. Since the idea of legal leasehold rights of the rural house sites cannot cover the rich needs in practice, it is necessary to reconstruct the rights system on the rural house sites by systematically integrating multiple measures. Taking the "three bottom lines" and "systematic classification design" as the guiding ideology and basing on the summarization of practical experience and theoretical research results, this paper proposes a reconstruction scheme of rights system on the rural house sites that takes "extending rights+transferring rights+separating rights" as its core content, so as to provide reference for the further reformation and improvement of legislation against the background of implementing the rural revitalization strategy. |
