Thepracticalexplorationofbigdatasupervisionbydisciplinaryinspectionandsupervisionorgansinmanyplaceshaspromotedthemodernizationofpowersupervisionandrestrictionmechanisms,andgiverisetoquestionsaboutthelegitimacyofbigdatasupervision.Thecurrentpracticeofbigdatasupervisionlacksbothstandardizedbigdatasupportandclearbigdatasupervisioncriteria,andhasproblemsofinsufficientempowermentandlimitedcompetenceattheinstitutionallevel.Theimprovementofthebigdatasupervisionsystemrequiresnotonlyinstitutionallyempoweringdisciplinaryinspectionandsupervisionorganstosharebigdata,butalsostrengtheningtherestrictiononthebigdatasupervisionpowerofdisciplinaryinspectionandsupervisionorgans,soastoresolvetheconflictsbetweendatarulesandsupervisionrules,andbetweendigitallogicandlegalprofessionallogic.Chinashouldclarifythepowerofdisciplinaryinspectionandsupervisionorganstosharegovernmentbigdataandtherulesfortheacquirementanduseofprocuratorial,judicial,andpublicsecuritydataandlegalsupervisiondata,standardizetheuseoftechnicalinvestigationmeansbydisciplinaryinspectionandsupervisionorgans,andimprovetheinstitutionofdatainquiryinnon-casefilingsituations.Wheninvestigatingcasesinvolvingsuspectedcrimes,disciplinaryinspectionandsupervisionorgansshouldcollect,acquireandfixevidenceinaccordancewiththerulesofevidenceincriminalprocedure,soastopreventsuchevidencefrombeingexcludedduetoviolationoflegalprocedures. |
