多元解纷机制是由各种解纷主体、解纷资源和解纷方式关联组合而成的有机系统,是中国特色社会主义司法制度的重要内容。近年来,为应对社会基础变迁所带来的挑战,回应纠纷治理的要求,基层多元解纷机制建设注重依靠党政组织的统筹与协调,实现了不同解纷主体的充分合作,以及解纷资源的集中配置与解纷方式的紧密衔接,基层多元解纷机制由此形成了一种要素聚合的新结构。由于注入解纷要素聚合结构中的政治势能和组织平台存在强弱差异,解纷要素的聚合形态也相应有所不同,多元解纷机制进而分化为不同模式。当前各地基层多元解纷多样且复杂的实践形态,是多元解纷机制模式分化的现实表征。进一步优化多元解纷机制,需要围绕党政统筹与协调下解纷要素聚合这一结构形态展开,具体途径包括控制模式分化的幅度、合理发挥政治势能的作用以及规范组织平台的运行。

英文摘要:

The diversified dispute resolution mechanism, an organic system comprising different dispute resolution entities, resources and methods, is an important part of the socialist judicial system with Chinese characteristics. In recent years, to address the challenges of social transformation and meet the demands of dispute governance, China has emphasized the coordinating role of Party and government authorities in the construction of the grassroots diversified resolution mechanism, thereby realizing sufficient cooperation among different dispute resolution entities, centralized allocation of dispute resolution resources, and close integration of dispute resolution methods. As a result, the diversified grassroots dispute resolution mechanism has evolved into a new structure characterized by the convergence of dispute resolution elements. The political potential energy and the establishment of organizational platforms injected into the convergence structure of dispute resolution elements vary in their strength and engender different convergence forms of dispute resolution elements, leading to different modes of the diversified dispute resolution mechanism. The complex and varied practices of diversified dispute resolution in different regions reflect the mode differentiation of the dispute resolution mechanism. Further optimization of the diversified dispute resolution mechanism necessitates prioritizing the convergence of dispute resolution elements through the coordination between Party and government authorities, which encompasses controlling the degree of mode differentiation, giving appropriate play to the role of political potential energy, and standardizing the operation of organizational platforms.
