| 行政必须转换模式，以适应社会转型的需要。压制型行政模式立足强制，以维护公共利益为唯一目标。否认相对方利益的正统性，只适用于维护“机械团结”的社会秩序。以“有机团结”为典型特征的现代社会，需要确立回应型行政模式，通过非强制行政行为，统合多元利益，培育社会自治，汲取社会智识资源，催生行政民主。以人文主义为精神核心的现代行政法，弘扬人的主体性，从不同层面推动现代社会迈向回应型行政模式。 |

| The model of administration must be adapted to the needs of the transitional society.Repressive model of administration is based on coercion and takes the upholding of public interests as its sole objective. It denies the legitimacy of the interests of the opposite party and is therefore suitable only for upholding a social order based on /mechanical solidarity0. Modern society, which is characterized by / organic solidarity0, calls for the establishment a responsive model of administration, which, through non2coercive administrative acts, integrates plural interests, cultivates social autonomy, draws on social intellectual resources, and promotes administrative democracy. Modern administrative law, with humanism as its spirit core, gives full play to the subjectivity of human beings and pushes modern society towards responsive model of administration. |
