中国式法治现代化以历史为本,同时以中华优秀传统文化为旨归,不断完善“文化中国”的法律体系构建。八二宪法之“文化中国”的国家目的条款,将规范秩序的合法性奠基于历史、文化与传统所构筑的正当性之中,亦即一种多元兼容而悠久审慎的历史观念。同时,八二宪法之“文化国”的国家目标条款,尤其是保护历史文化遗产的基本国策,通过文化遗产法的观念变迁与体系化,以法律守护着历史文化。当代中国法治这种近乎本能地的文化复归,一方面脱胎于中华传统文化对于国家建构的根本规定性,一种经与史、道与事、规范性与经验性、法律与文化彼此互构的观念;另一方面又因应现代法治国的形式,化身为宪法及文化遗产法的概念与规范、体系与机制。可见,当代中国的法治实践不断对中华法律传统与世界法律文明进行着双重转译,从而催生着中国法的创造性转化与创新性发展。

英文摘要:

As a historically rooted spiritual entity, the Chinese-style modernization of the rule of law is also anchored in Chinese traditional culture, thus continuously perfecting the legal framework of “Cultural China”. The national purpose clause in the 1982 Constitution on “Cultural China” bases the legitimacy of the normative order on the legitimacy constructed by history, culture, and tradition, i. e., a historical notion that is compatibly diverse and prudently longstanding. In addition, the state objective clause in the 1982 Constitution on the “cultural state”, especially the basic national policy of protecting historical and cultural heritage, undergoes the conceptual shift and systematization of the cultural heritage law, thus safeguards the historical culture of China with law. The contemporary Chinese rule of law,which almost instinctively returns to culture, is born from the fundamental normativity of Chinese traditional culture in national construction and governance, which is a concept of inter-structure between classics and history, doctrine and practice, normativity and experience, and law and culture. It also adopts the modern form of the rule of law, manifesting itself as concepts and norms, systems and mechanisms in the Constitution and the cultural heritage law. Thus, contemporary Chinese legal practices are constantly engaged in a dual translation of Chinese legal traditions and global legal civilization, which promotes the creative transformation and innovative development of Chinese law.
